This Privacy Notice describes how TRCare collects and uses your information when you visit, access or make use of the website located at https://MyTRCare.com (the "Site"), or the other current and future online and or mobile websites, platforms, services, applications, and networks owned or operated by TRCare (the Site and these other websites, platforms, services, applications and networks constituting the "Service"). This Privacy Notice also explains your rights in relation to your information. By visiting, accessing or using the Service, you expressly consent to our collection, storage, use and disclosure of your information as described in this Privacy Notice. Please note that if you disagree with anything in this Privacy Notice, you must not use the Service. This Privacy Notice is part of, and is governed by, the terms and conditions set forth in our Terms of Service located here: www.trcare.net/terms.
PLEASE NOTE THAT IN CERTAIN CASES, THE USE AND PROCESSING OF YOUR INFORMATION MAY ALSO BE GOVERNED BY THE PRIVACY NOTICE OF ONE OR MORE THIRD PARTIES AS SET FORTH IN SECTION 3 BELOW.
1. COLLECTION OF INFORMATION
We collect various types of information from you when you use the Service, as follows:
PERSONAL INFORMATION. This is information that alone or when in combination with other information may be used to readily identify, contact, or locate you, such as: name, address, email address, DOB, and or gender. We do not consider Personal Information to include information that has been anonymized so that it does not allow a third party to easily identify a specific individual.
HEALTH-RELATED INFORMATION. This is information such as physical assessment data entered by an individual when using the Service. This information is only visible to the individual owner and their associated clinician and does not allow any third party to identify a specific individual.
A. CONSENT. By using the Services, you consent to the use of your Personal and Health-related Information as described in this Privacy Notice. Except as set forth in this Privacy Notice, your Personal Information will not be used for other purposes without your consent. We do not collect Personal or Health-related Information for the purpose of sale of such information in a way that identifies the individual. You may withdraw your consent to our processing of your Personal and Health-related Information at any time. However, withdrawing consent may result in your inability to continue using some or all of the Services.
B. INFORMATION YOU DIRECTLY AND VOLUNTARILY PROVIDE TO US. If you elect to create an account on the Service, you will be required to provide Personal Information. By choosing to create an Account, you are voluntarily providing the information requested as part of the registration process.
C. INFORMATION AUTOMATICALLY COLLECTED THROUGH THE SERVICE.
Analytics Information - As you use our Service, we may also collect information through the use of information-gathering tools, such as Google Analytics, cookies, log files, and web beacons. Such Information may include standard information regarding your mobile device, browser type, browser language, Operating System, Internet Protocol (“IP”) address, location, and the actions you take on our website such as the web pages viewed and the links clicked while using the Service. Collectively, this information is referred to as “Analytics Information.”

However, if you disable cookies you may not be able to log in to the Service or to use certain features of the Service. D. INFORMATION COLLECTED BY THIRD PARTIES THROUGH THIRD PARTY LINKS AND CONTENT. The Service does include links to third party websites for services such as support and surveys but does not include links to social media websites.
E. INFORMATION YOU POST ON THE SERVICE. Clinicians are allowed to post custom exercise videos to service. You are not allowed to post to the Service at this time.
F. INFORMATION YOU SHARE ON THIRD PARTY WEBSITES OR THROUGH SOCIAL MEDIA SERVICES. The Service does include links to third party websites for services such as support and surveys but does not include links to social media websites.

2. HOW WE USE THE INFORMATION WE COLLECT FROM YOU
A. PROVIDING AND MANAGING THE SERVICE. TRCare may make use of your information to assist in the operation of our Service and to ensure delivery of the services you need and request. We also may use the information we gather through the Service to help us better understand how the Service and our product and/or service is being used. By identifying patterns and trends in usage, we are able to better design the Service and our products and services to improve your experience.
B. COMMUNICATING WITH YOU. TRCare may also use your information to contact you in connection with the completion of surveys and/or research questionnaires related to your opinion of current or potential future services that TRCare may offer. If you wish to opt-out of receiving these emails from us, please follow the instructions contained in each email you receive from us, which will allow you to opt-out of receiving further email marketing communications from us, or send an opt-out request to us at support@trcare.net.
C. ONLINE ADVERTISING; TRACKING. The Service will not use any information that it may collect through the service via cookies, web beacons, and other similar tracking technologies to engage in any online advertising programs. The Service also does not allow any third party to engage in any electronic advertising.

3. HOW WE SHARE YOUR INFORMATION WITH THIRD PARTIES
A. EMPLOYEES AND THIRD PARTY SERVICE PROVIDERS. We have put in place contractual and other organizational safeguards with our agents and contractors to ensure a proper level of protection of your Personal and Health-related Information (see further “Data Security” below). In addition to those measures, we will not disclose or transfer your Personal Information to third parties without your permission, except as specified in this Privacy Notice. Your information, including Personal and Health-related Information, may be transferred to and maintained on computers located outside of your state, province or other governmental jurisdiction where the data protection laws may differ than those in your jurisdiction. Your consent to this Privacy Notice followed by your submission of such information represents your agreement to that transfer. We will take all steps reasonably necessary to ensure that your Personal and Health-related Information is treated securely and in accordance with this Privacy Notice and no transfer of your Personal and Health-related Information, will take place to an organization unless there are adequate controls in place including the security of your information. From time to time we may employ third parties as contractors to help us provide and/or improve the Services. These third parties may have limited access to Personal and Health-related Information solely for the purpose of helping us to provide and/or improve the Service and they will be subject to contractual restrictions prohibiting them from using the information about our users for any other purpose. Such agents or third parties do not have any rights to use Personal and Health-related Information beyond what is necessary to assist us.
B. RESPONSE TO SUBPOENAS OR COURT ORDERS OR TO PROTECT RIGHTS AND TO COMPLY WITH OUR POLICIES. To the extent permitted by law, we will disclose your information to government authorities or third parties if: (i) required to do so by law, or in response to a subpoena or court order; (ii) we believe, in our sole discretion, that disclosure is reasonably necessary to protect against fraud, to protect the property or other rights of TRCare, other users, third parties and/or the public at large; or (iii) we believe that you have abused the Service by using it to attack other systems or to gain unauthorized access to any other system, to engage in spamming or otherwise to violate applicable laws. You should be aware that, following disclosure to any third party, your information may be accessible by others to the extent permitted or required by applicable law.
C. BUSINESS TRANSFERS; BANKRUPTCY. In the event of a merger, acquisition, bankruptcy or other sale of all or a portion of our assets, any user information owned or controlled by us may be one of the assets transferred to third parties. We reserve the right, as part of this type of transaction, to transfer or assign your information and other information we have collected from users of the Service to third parties. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred user information will be subject to this Privacy Notice. However, any information you submit or that is collected after this type of transfer may be subject to a new Privacy Notice adopted by the successor entity.
D. AGGREGATE INFORMATION - We may share information relating to users of the Service with affiliated or unaffiliated third parties on an anonymized aggregate basis..
4. CHILDREN UNDER AGE 13
The Service is available to children under the age of thirteen (13) only if TRCare has obtained and reviewed all required information and permissions, including verifiable affirmative consent, from your parent or legal guardian. If a parent or legal guardian consents to a child's participation and provides Personal Information regarding such child, we will collect, share and use such information in the same manner as described for adults in this Privacy Notice. TRCare can provide parents and/or legal guardians with access to review their child's Health-related Information. TRCare will provide parents the opportunity to prevent further use or online collection of their child's Health-related Information by providing a methodology for parents to request to have their child’s account deleted.

5. DATA SECURITY, INTEGRITY, AND RETENTION
The TRCare platform subscribes to and follows the HIPAA Security Rule.
A. HOW WE PROTECT YOUR PERSONAL INFORMATION. The security of your Personal and Health-related Information is very important to us. TRCare uses commercially reasonable efforts to implement industry standard security measures intended to protect against the loss, misuse and alteration of your information under our control. TRCare also uses commercially reasonable technical, administrative, and physical safeguards to preserve the confidentiality, integrity, and availability of the information that you provide to us. The Service employs a variety of security safeguards to protect your information including supporting Transport Layer Security (TLS)/Secure Sockets Layer (SSL) certificate technology and encryption. We have implemented procedures designed to limit the dissemination of your information to only such designated staff as are reasonably necessary to carry out the stated purposes we have communicated to you. Nevertheless, please be aware that no data transmission over an Internet-connected network can be guaranteed to be 100% secure. As a result, TRCare cannot guarantee or warrant the security of any information you transmit on or through the Service and you do so at your own risk.
B. RETENTION. We will keep your Personal and Health-related Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, anonymized information, or account recovery. All retained information will remain subject to the terms of this Privacy Notice. Please note that if you request that your Personal and Health-Related Information be removed from our databases, it may not be possible to completely delete all of your information due to technological, legal, or contractual constraints.
C. WITHDRAWAL OF CONSENT. You may withdraw your consent to the use of your Personal and Health-related Information from the Service at any time. To do this, please contact TRCare Support at support@trcare.net.
6. CHANGES TO THIS PRIVACY NOTICE
TRCare reserves the right to update and/or change the terms of this Privacy Notice. We will notify you of material changes to this Privacy Notice by providing notice on the Site. Accordingly, you are responsible for periodically reviewing this Privacy Notice so that you are informed about the type of information we collect, how it will be used, and under what circumstances, if any, we may disclose your information. If you do not agree to the changes, you should discontinue your use of the Service prior to the time the modified Privacy Notice takes effect. If you continue using the Service after the modified Privacy Notice takes effect, you will be bound by the modified Privacy Notice. Where practical, we will try and provide advance notice of changes to this Privacy Notice, but if the Privacy Notice is not reviewed online or elsewhere regularly, you may not receive actual advance notice of changes.
7. ACCEPTANCE OF TERMS
When you visit, access or use of the Service, you accept the terms of this Privacy Notice. If you do not agree with the terms of this Privacy Notice, then you should not use the Service.
8. SPECIAL INFORMATION FOR CALIFORNIA RESIDENTS
A. If you are a California resident under the age of 18 and are a registered user of the Service, you may request that we remove content or information that you entered using the Service that is stored on our servers by (i) submitting a request to TRCare Support at support@trcare.net and (ii) clearly identifying the content or information you wish to have removed and providing sufficient information to allow us to locate the content or information to be removed. However, please note that we are not required to erase or otherwise eliminate content or information if (a) other state or federal laws require us or a third party to maintain the content or information; (b) the content or information was copied or stored by another user; (c) the content or information was anonymized so that the minor cannot be individually identified; (d) the minor does not follow the instructions posted in this Privacy Notice on how to request removal of such content or information; and (e) the minor has received compensation or other consideration for providing the content. Further, nothing in this provision shall be construed to limit the authority of a law enforcement agency to obtain such content or information.
